Revenue Engine Terms of Service

Revenue Engine is made by CHRISPSDesign ("we"), the Canadian company that owns Utilwell. These terms apply to every store ("you") that uses Revenue Engine.
1. The service
Revenue Engine reads your Shopify store data, finds and ranks revenue opportunities, drafts campaigns for your approval, exports approved audiences for your email tool, and measures results against a held-back group. Its access to Shopify is read-only: it never sends emails, creates discounts, changes prices or edits your store.
2. Setup and fees
Each store gets its own private installation, which we set up with you. Fees, what's included and the billing period are agreed with you in writing before setup. You can stop at any time by uninstalling the app.
3. Your responsibilities
- You decide which campaigns to approve and send. You are responsible for their content and for complying with email-marketing law, such as consent and unsubscribe requirements, in the tool you send from.
- Figures are labelled as observed, calculated, predicted or measured. Predictions and assumptions are estimates; only results measured against a held-back group are reported as proven.
4. Data processing
For your customers' personal data, you are the controller and we are your processor. We:
- process it only to provide Revenue Engine to you, as described in the privacy policy, and never sell it or use it for any other store;
- keep the minimum needed, and keep customer email addresses only in the recipient files of campaigns you launch;
- keep your installation separate, encrypted in transit and at rest, with access limited to the developer;
- delete a customer's records when Shopify sends a customer deletion request, and delete your store's data 48 hours after uninstall;
- use Render (hosting) as our only sub-processor, and tell you before adding another. If you connect your own Omnisend account, data you approve for a campaign is sent there under your agreement with Omnisend;
- tell you without undue delay, and within 72 hours, if we become aware of a breach affecting your data, and help you meet your own obligations.
5. Availability and liability
We aim to keep Revenue Engine available and to fix problems quickly, but it is provided "as is". To the extent the law allows, our total liability is limited to the fees you paid for Revenue Engine in the 12 months before a claim, and we are not liable for indirect or lost-profit losses.
6. Changes
We may update these terms. We will tell you about material changes before they take effect.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Nothing in them limits rights you have under consumer protection law that cannot be limited.
